PI Opioid Claims

THE CLAIMS SUBMISSION DEADLINE FOR PI OPIOID CLAIMS WAS 30 DAYS AFTER THE EFFECTIVE DATE, OR BY MAY 23, 2024.  Due to the short filing period, The PI Trust began accepting PI Opioid Claims on April 1, 2024, prior to the Effective Date, with any PI Opioid Claims submitted before the Effective Date to be deemed received by the PI Trust on the Effective Date for claims processing purposes.

A PI Opioid Claimant is a person who has a personal injury claim for alleged opioid related injury and does not qualify for a NAS (neonatal abstinence syndrome) PI Claim.

A PI Opioid Claim means any and all present private opioid claims against any of the Debtors (a) held by a natural person (1) resulting from an injury to such natural person identified on the Claim Form, which injury resulted from such natural person’s exposure to Opioids or Opioid replacement treatment medication, and (2) arising from such natural person’s use of an Endo Qualifying Opioid or the use by a decedent of an Endo Qualifying Opioid prior to January 1, 2019, and (b) for which a Proof of Claim was filed by the General Bar Date of July 7, 2023.  See the PI Trust Distribution Procedures (TDP) for PI Opioid Claims.

In order to be able to file a PI Opioid Claim, the claimant must have first filed a Proof of Claim against the Debtor in the Chapter 11 Bankruptcy case by the General Bar date of July 7, 2023, set by the Bankruptcy Court.  However, in order to be eligible to receive funds from the PI Trust, the Claimant must also file a PI Opioid Claim form and any required documentation by the CLAIMS SUBMISSION DEADLINE, WHICH WAS 30 DAYS AFTER THE EFFECTIVE DATE, OR BY MAY 23, 2024.

You can file a PI Opioid Claim if you can demonstrate that:

  1. you received a prescription before January 1, 2019, for an Endo opioid, including any prescription for off-label use; and
  2. you were injured from the Endo opioid use on or before July 7, 2023; and
  3. you filed a Proof of Claim by the General Bar Date of July 7, 2023.

FILING A CLAIM

If you are filing a PI Opioid Claim, you must submit to the Trustee the PI Opioid Claim Form and supporting documentation as explained in the Endo Opioid Personal Injury Trust Distribution Procedures (the “PI TDP“) and PI Opioid Claim FAQs provided above.

PI Opioid Claim Forms and supporting documentation can also be filed by printing the PI Opioid Claim Form and other required documents above, completing them and returning them with your supporting documentation to:

Please note, if filing a PI Claim you must do the following:

  1. Have timely filed a Proof of Claim against one or more Debtors on or before the July 7, 2023, Bar Date
  2. Complete, sign, and submit the PI Claim Form
  3. Submit proof of usage of a Qualifying Opioid, with the prescription dated before January 1, 2019
  4. Complete, sign, and submit the HIPAA Release Form

You may also be required to include the following:

  1. If the PI Opioid Claimant is a Minor, documentation to show you are a qualified Proxy who is authorized to file a PI Opioid Claim on the minor’s behalf. You will need to execute the Proxy Form and provide the required documentation.
  2. If the PI Opioid Claimant is deceased, a certified death certificate must be provided AND:
    1. If an Estate has been opened, provide Estate Documentation;
    2. If an Estate has not been opened, the person filing the claim should complete and submit the Heirship Declaration Form.
